Notes on submitting an application

On the basis of the legal provisions on Federal Plant Variety Office procedures, it is not possible to transmit application documents using data storage media (email).

Notes on completeness regarding applications for plant breeders’ rights and national listing:

Please note that applications for plant breeders’ rights and national listing that are submitted to the Federal Plant Variety Office in paper form are only complete, and only constitute a valid application, when the technical survey is included in the documents. Applications which do not adhere to this requirement do not constitute a valid application under law for plant breeders’ rights or national listing and will not be assigned a filing date.

In this regard, please also note that, in cases where complete applications are submitted by fax, the originals do not need to be submitted at a later date.
