Variety Control

From a registered or protected variety it is required that it remains the same as at the time of registration or at the time the Plant Breeders' Rights was granted. This requires that maintenance breeding is carried out systematically. The result of this work is controlled by the Bundessortenamt.

In seed propagated varieties the Bundessortenamt stores a seed sample of each registered and/or protected variety. This is the official reference seed sample during the lifetime of a variety and samples taken from the market have to accord to this reference.

Vegetatively propagated varieties are compared, where necessary, with existing similar reference varieties, or - where possible - by electrophoresis. If a variety is not maintained properly and proves to be no longer stable the Bundessortenamt deletes the variety from the National List or terminates the Plant Breeders' Right.
